Contract for sale of Pet/Companion Akita

This dog is being sold as a pet and/or companion animal. The purchaser agrees to the following conditions:

Health is guaranteed for a period of 7 days after purchase date.

The purchaser will have the dog examined by a licensed veterinarian within 72 hours of taking delivery; otherwise the purchaser assumes all responsibility for any illness.

It is understood that this dog is not to be used for breeding and therefore a limited registration certificate is provided. The non-breeding agreement can only be lifted by the seller if the dog proves to be of sufficient quality and temperament, as well as passing OFA certifications and all other relevant health checks. Otherwise, the dog shall be neutered.

The dog is guaranteed to be free of any hereditary or congenital abnormalities that would prevent it from being a good pet and companion.

The guarantee is valid for a period of 26 months. This gives buyer time for required OFA submissions at 24 months. Buyer will receive additional time for this test in the event health of dog prevents prompt submission.

If the dog is unsuitable as a pet in accordance with the above terms, it will be replaced provided it is returned to the seller at the purchaser’s expense. Any other arrangement has to be approved by the seller.

In the event that the dog’s condition necessitates euthanasia, permission from the seller must be given.

The terms of this agreement are void if the dog is used for breeding.

If the purchaser finds for any reason that he/she cannot keep this dog, it shall be returned to the seller at purchaser’s expense. Any other arrangements have to be approved by the seller.

The purchaser of the above-described dog further agrees to the following conditions.

Feed the dog according to the directions provided by the seller or a licensed veterinarian.

Provide for the welfare of the dog by yearly health checks, a parasite prevention program, yearly vaccinations as recommended by his veterinarian, and heart-worm prevention where applicable.

Provide a clean, safe environment where the dog will not be subject to teasing or abuse.

The dog will not be allowed to run at large or be chained at any time.

The dog or any of its offspring will not be sold, leased, consigned or given to any pet shop, chain store, dog dealer, commercial breeding kennel, puppy mill or individual for resale or breeding purposes.

In no case will the seller be held liable for any damage or injury caused by this dog.

The registered name of the dog shall begin with the word AIKO’S.

In the event that the terms of this agreement are not complied with the seller is entitled to $5,000 in damages and the return of the dog plus any legal fees and costs associated with the enforcement of this agreement.
